Terms & Conditions Agreement

Acceptance of Terms
By scheduling service, approving an estimate, providing payment information, or allowing work to begin, you acknowledge that you have reviewed and agree to these Terms & Conditions, whether or not you sign below.

These Terms and Conditions apply to all appliance repair, service, maintenance, delivery, and installation services performed by CW Services Holdings, LLC (dba C&W Appliance Service) (“C&W,” “Company,” “we,” or “our”).

By scheduling service, approving an estimate, paying a deposit, or allowing work to begin, the customer (“Customer”) agrees to the terms below.

  1. Scope of Services

C&W Appliance Service provides appliance repair, maintenance, delivery, and installation services for residential and commercial customers.

Services may include:

  • Appliance diagnosis and repair
  • Replacement of defective components
  • Delivery and installation of appliances
  • Basic operational testing
  • Reconnection of existing plumbing, electrical, or gas lines where applicable

Unless specifically quoted in writing, services do not include:

  • Cabinetry modification
  • Structural carpentry
  • Flooring modification
  • Electrical rewiring beyond standard connection
  • Plumbing work beyond basic reconnection
  • Permit acquisition or code compliance
  • Cosmetic repairs such as painting, patching, drywall repair, or trim work

Additional work required to complete the job must be approved by the customer and may result in additional charges.

  1. Payment Terms

Payment is due upon completion of service unless otherwise agreed.

Accepted forms of payment may include:

  • Credit card
  • Electronic payment
  • Check

By scheduling service or providing payment information, Customer authorizes C&W Appliance Service to charge the payment method on file for:

  • Service call fees
  • Labor and materials
  • Installation charges
  • Additional approved work
  • Trip charges or cancellation fees

Invoices not paid when due may be subject to collection costs.

  1. Scheduling and Cancellation

Appointments are scheduled based on technician availability.

Cancellations or rescheduling must be made at least 48 business hours before the scheduled appointment.

If technicians arrive and the site is not accessible, safe, or ready for service, a trip charge may apply.

  1. Customer Responsibilities

Customer agrees to provide safe and reasonable access to the appliance and surrounding work area.

Customer responsibilities include:

  • Ensuring appliances are accessible for service
  • Clearing surrounding work areas
  • Securing pets and children away from work areas
  • Ensuring safe working conditions for technicians

If site conditions prevent safe service, C&W Appliance Service may reschedule the work.

C&W Appliance Service reserves the right to stop or refuse work if conditions are unsafe, non-compliant, or likely to result in damage.

  1. Appliance Movement

Technicians may need to move appliances to perform service or installation.

Moving appliances carries inherent risk, including possible damage to:

  • Flooring
  • Cabinetry
  • Countertops
  • Walls or trim
  • Appliances themselves

Customer authorizes necessary movement of appliances and acknowledges these inherent risks.

  1. Water Connection Risk

Many appliances connect to plumbing systems including refrigerators, ice machines, dishwashers, and beverage equipment.

Working with water-connected appliances carries inherent risk of leakage, flooding, or component failure.

Customer acknowledges this risk and agrees to hold C&W Appliance Service harmless for damages resulting from water-related failures except in cases of proven gross negligence or willful misconduct.

  1. Customer Responsibility After Service

Customer agrees to monitor the appliance immediately after service or installation. If any issues are observed (including leaks, unusual operation, or performance concerns), Customer agrees to immediately shut off water, gas, or power to the appliance and contact C&W Appliance Service.

C&W Appliance Service shall not be responsible for damages resulting from continued operation of an appliance after a problem is observed or should reasonably have been observed.

  1. Refrigeration and Cooling Equipment Risk

Refrigeration systems contain complex mechanical and electronic components.

Repairs are based on symptoms observed during diagnosis and may not identify all underlying issues.

Customer acknowledges that refrigeration failure may result in:

  • Food spoilage
  • Product loss
  • Business interruption
  • Inconvenience

C&W Appliance Service shall not be responsible for such losses.

  1. Diagnostic Limitations

Appliance diagnosis is based on observable symptoms and available testing methods.

Additional issues may become apparent during repair.

If additional problems are discovered:

  • Estimates may change
  • Customer approval may be required before additional work proceeds

Appliance repairs are not guaranteed to resolve all issues, and additional failures may occur due to the age, condition, or complexity of the appliance.

  1. Customer-Supplied Parts

If Customer supplies parts, accessories, panels, or materials:

  • Compatibility cannot be guaranteed
  • Installation success cannot be guaranteed
  • C&W assumes no responsibility for defects in customer-supplied materials
  1. Installation Site Requirements

For appliance installations, Customer is responsible for ensuring the installation site meets manufacturer requirements.

Customer must ensure:

  • Cabinetry openings meet manufacturer specifications
  • Flooring is fully installed and cured
  • Electrical, gas, and water connections are installed and operational
  • Required accessories and panels are onsite
  • Clear access exists for appliance delivery and installation

If installation cannot proceed due to site conditions, additional charges may apply.

  1. Flooring and Surface Protection Disclaimer

C&W technicians take reasonable precautions when moving appliances.

However flooring materials such as:

  • Hardwood
  • Marble
  • Tile
  • Vinyl
  • Engineered flooring

may be susceptible to scratches, dents, or pressure damage.

C&W Appliance Service shall not be responsible for damage resulting from normal appliance movement across existing flooring surfaces.

  1. Custom Panels and Trim

Many luxury appliances use custom panels or trim supplied by cabinetmakers or other contractors.

C&W Appliance Service is not responsible for:

  • improperly fabricated panels
  • warped panels
  • misaligned panel hardware
  • cosmetic defects in customer-supplied panels

Panel adjustments related to fabrication issues must be handled by the cabinetmaker.

  1. Photo Documentation

Technicians may photograph installation or service conditions before, during, and after work.

These images may be used for:

  • documentation
  • quality assurance
  • warranty review
  • insurance purposes
  1. Warranty

C&W Appliance Service provides a 90-day workmanship warranty on applicable services.

This warranty applies only to labor performed by C&W.

Warranty does not apply if:

  • work is modified by others
  • appliances are moved after installation
  • manufacturer instructions are not followed

Manufacturer warranties remain the responsibility of the appliance manufacturer.

  1. Limitation of Liability

To the fullest extent permitted under Texas law:

To the fullest extent permitted under Texas law, C&W Appliance Service’s total liability for any claim arising from services performed shall not exceed the amount paid by the customer for the specific service performed, regardless of the type of claim.

C&W shall not be liable for:

  • consequential damages
  • food loss
  • loss of use
  • business interruption
  • lost profits
  • indirect damages
  1. Damage Claims

Any claim for damage must be reported within 72 hours of service completion and must include supporting photographs.

Failure to report within this timeframe constitutes acceptance of the completed work.

  1. Force Majeure

C&W Appliance Service shall not be responsible for delays caused by events outside its control including:

  • weather
  • supply chain delays
  • parts availability
  • unsafe jobsite conditions
  • utility outages
  1. Governing Law

These Terms shall be governed by the laws of the State of Texas.

Any dispute arising from services performed by C&W Appliance Service shall be resolved in Dallas County, Texas.

  1. Builder / Designer / Contractor Responsibility

In projects involving new construction, remodels, or coordination with other trades, the builder, contractor, architect, or designer is responsible for ensuring that all installation conditions meet appliance manufacturer specifications prior to C&W Appliance Service beginning work.

This includes but is not limited to:

  • Cabinetry dimensions and structural support
  • Appliance clearances and ventilation requirements
  • Proper placement of electrical outlets and junction boxes
  • Gas supply lines and shutoff valves
  • Water supply lines and drain connections
  • Structural flooring capable of supporting appliance weight

C&W Appliance Service performs installation services based on visible site conditions and information provided by the customer, builder, or project manager.

C&W Appliance Service shall not be responsible for design errors, specification errors, improper construction, or utility placement performed by others.

If installation cannot be completed due to improper site preparation, additional labor charges, trip charges, or rescheduling fees may apply.

When installations occur in construction environments, the builder or project manager is responsible for coordinating the readiness of the job site and for verifying that manufacturer specifications have been satisfied prior to the scheduled installation.

  1. Concealed Plumbing, Electrical, and Structural Conditions

Appliances frequently connect to existing plumbing, gas, and electrical systems located behind cabinetry, walls, or floors.

These systems may include hidden defects, wear, corrosion, or improper installation that are not visible prior to service.

C&W Appliance Service does not perform destructive inspection of walls, cabinets, or floors and cannot evaluate concealed infrastructure prior to performing installation or repair.

Customer acknowledges that:

  • plumbing connections may fail after reconnection
  • electrical wiring may contain hidden defects
  • existing shutoff valves may fail when operated
  • concealed water lines may leak after service
  • structural cabinetry or flooring may be insufficient to support appliance weight

Customer agrees that C&W Appliance Service shall not be responsible for damages resulting from hidden or pre-existing plumbing, electrical, gas, or structural conditions that were not visible prior to service.

If unsafe or defective infrastructure is discovered during service, technicians may stop work and recommend that a licensed plumber, electrician, contractor, or other specialist correct the issue before work proceeds.

  1. Luxury Appliance Panel and Custom Finish Disclaimer

Many high-end appliances utilize custom cabinet panels, trim kits, and decorative hardware that are manufactured or installed by cabinetmakers or third-party trades.

C&W Appliance Service is not responsible for:

  • misaligned or improperly fabricated panels
  • warped or unfinished panels
  • panel hardware supplied by others
  • damage caused by improper panel construction
  • cosmetic imperfections in customer-supplied panels

Customer acknowledges that custom panels and trim components must meet manufacturer specifications and must be installed or adjusted by the cabinetmaker if fabrication issues exist.
